Standard ICC arbitration clause
An arbitration agreement referring to the ICC Rules of Arbitration is an essential prerequisite to the commencement of proceedings. For this reason, the ICC International Court of Arbitration proposes a standard arbitration clause for parties to include in their contracts. It provides a minimum of information, which parties may extend, if desirable, by specifying the law governing the contract, the number of arbitrators and the place and language of the arbitration.
Although its official working languages are English and French, the ICC International Court of Arbitration publishes the standard arbitration clause in many other languages for the convenience of parties whose contracts may be drafted in such languages. A full list of the translations of the clause so far available is given below.1

" All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules."

ICC Commission on Arbitration: work in progress
The ICC Commission on Arbitration has created four new task forces to study matters of current relevance to ICC dispute settlement services. Task forces are periodically set up within ICC's various commissions to undertake specific projects and report back to their parent body. Those set up under the auspices of the ICC Commission on Arbitration are composed of persons nominated by ICC national committees and may also include members of the ICC International Court of Arbitration.
In conjunction with the launch of ICC's new Rules for Expertise,2 two task forces have been set up to study the complementary questions of suggested ICC expertise clauses for inclusion in international business contracts, and guidelines for the conduct of ICC expertise proceedings. These task forces are chaired respectively by Commission members Phillip Capper, a London partner of the law firm Lovells, and Hilmar Raeschke-Kessler, lawyer at the German Federal Court of Justice in Karlsruhe.
In light of the growing interest in dispute boards as a means of resolving disputes, a task force has been created to study specific issues in this field, including the drafting of model dispute board clauses for parties to include in their contracts, a model contract for dispute board members and rules of procedure. Pierre Genton, partner of PMG Consulting Engineers in Lausanne, Switzerland, and dispute board specialist, is in charge of this task force.
A fourth task force chaired by Commission member Erik Schäfer, attorney with Cohausz & Florack in Düsseldorf, Germany, has been constituted to study information technology in arbitration proceedings and draft a protocol and guidelines to help make its use in this field as simple and efficient as possible.
Secretariat appointment
Eliseo Castineira has been appointed Counsel at the head of one of the ICC Court Secretariat's seven case management teams. He replaces Denis Bensaude, who has left the Secretariat to join a leading Paris law firm.
Eliseo Castineira, who holds French and Spanish citizenship, began his legal studies in France. After graduating in law from the University of Paris X, he took a Master of Laws degree at the New York University School of Law. In his professional career, he has concentrated in particular on corporate affairs and mergers and acquisitions, which he practised with two major international law firms in Paris. Mr Castineira is a member of the Bar in France and speaks French, Spanish and English.
